近年来移民法改变了许多,而我早已经没有关注新法,所以不便给意见
如果有签证的问题, 建议发帖问达人,或者发帖求律师推荐, 这样才能得到更准确更合适的信息。

4) 签10年永居

见过的律师少说也有20个, 还不包括电话里咨询的那些。 大部分律师都不了解我的情况,和网上大部分的人理解的一样, 他们觉得只要我被拒签了10年就是断开了。但是他们当然愿意我奉上 1,2千镑给他们帮我去‘试一试’。 我开始也是这样认为, 以为只有试一试了, 我也认为我的签证是属于断开了, 而10年的要求是合法与连续的10年。 所以,我那时候决定不找律师,自己申请10年永居,如果失败了就回国或者去别的国家。

这时候听到一个不幸的消息。 上诉期间在苹果上认识一个同学, 他跟我的CASE一模一样,他后来也是败诉后回国申请再回来。 他说他刚申请10年被拒了。。。。但是他跟我不一样的地方是, 他败诉后20多天才回国的,(走的时候已经没有上诉权了),还有他申请10年的时候current visa 还没有过期。 可是后来,过了几个月他又递交了第二次申请,对第一次申请连解释都没有解释,结果就拿到永居了。我估计他第二次递交的时候current visa快过期了,所以HO不想打官司就过了。

抱着不成功就算了的态度,我研究了所有相关的Home Office Guidance, 但是我发现,Guidance 关于GAP的例子和说法都过于简单,根本没有,甚至接近我的case的例子或者条文。 然后我就从Guidance 的条文找线索, 研究别的法律上的条文。

因为我所有的签证都是合法的,所以我的10年主要的问题是10年签证的连续性。UKBA对这个‘连续性’的解释,其中有一句就是,‘如果一个人在离开UK的时候有valid leave to remain, 离开英国不超过6个月, 然后以同一个或者另一个valid leave to remain回到英国,他的签证是属于连续的。’

而在我的CASE中,这个‘连续性’看起来就是在我败诉后才断开的。 但是我想, 这个‘断开’到底是在我败诉后立刻断开,还是在我离开英国后才断开的? 这与我的上诉权和3C/D 的leave to remain有关。

  • 我要找证据证明我所有的申请和上诉都是in time application;
  • 只要是in time application, 就受3C/3D保护,也等于有valid leave to remain;
  • 只要我离开英国的时候有valid leave to remain, 然后只一个月就回来了,所以根据上面提到的一句,我的10年就是连续的。

UKBA Guidance 有这么一段关于3C 和3D leave的,相信大家都很熟悉了:

[i]‘To prevent applicants from becoming overstayers through no fault of their own, section 11 of the Nationality, Immigration and Asylum Act 2002 introduced an amended Section 3C into the Immigration Act 1971.
Section 3C extends leave when a person with leave to enter or remain makes an in-time application. That is one made before their leave expires, but one in which their leave expires before a decision on that application is reached. If a person has 3C leave, and their application is refused, 3C leave continues until their appeal rights are exhausted. Section 3C only applies to in-time applications.

To prevent people becoming overstayers while exercising a right of appeal against a decision to curtail or revoke leave to enter or remain, section 11 of the Immigration, Asylum and Nationality Act 2006 added section 3D to the Immigration Act 1971. When leave to enter or remain is curtailed or revoked, Section 3D extends it while an appeal is brought, while it is pending, and continues until appeal rights are exhausted.

Both 3C and 3D leave count as existing leave to enter or remain in the UK, and therefore as lawful residence for the purpose of the 10 year long residence rule.’[/i]

简单的说,这个条文的最重要的就是‘in time’, 必须签证申请,上诉申请都是in time submission, 就能受 3C/3D 的条例保护。就是说,如果你递交了in time 签证申请, 你就受3C保护,在申请期间有valid leave to remain; 如果你的申请被拒,只要你在规定时间内申请上诉,而且有上诉权, 你在上诉和等待结果期间就受3D保护,有3D的valid leave to remain.

为此, 我顺着每一条条例提到的文件 去找,比如说那些immigration Act, 我就去翻那些Act, 找对我的CASE 有利的条文。

从这些里面, 我找到了确保我一次,二次上庭都是on time applications. 确保了我这段时间都是受3C/3D保护的, 而且找到一句 ‘An appeal is abandoned if the appellant is granted leave to enter or remind in the UK or if he leaves the UK’ ! ! 我又尝试找了一些别的资料,都没有描写关于‘abandon appeal when leaving the UK’ 的具体描写。 所以我觉得: 由于我是在收到判决书后的8天内离开的, 我离开的时候还是拥有上诉权,受3D的保护,拥有3D 的leave to remain, 而这个valid leave to remain是到我离开英国的那一刻才失去的。 也就是说, 卡在我离开英国的那一秒来说,我是持有valid leave to remain的, 然后1个月后我以另一个valid leave to remain回到英国,所以我的10年是连续的。

当然,这些都很卡字眼,所以我不敢确定能否这样去看这个问题。 我离开英国导致我失去上诉权, 那这个‘上诉权的失去’,到底是怎么算的呢? 是在我离开英国的那一秒吗?还是从我得到上诉权,也就是判决书下来的那一天开始算? 如果是后者, 那我离开英国的时候就没有VALID LEAVE TO REMAIN 了, 我的10年就断开了。

我找了很多资料,包括上面列出的, 但是都没有找到这个关于一个人如果离开英国,他的的上诉权的失去到底从哪天开始算。 但是没有别的方法,所以我是打算就以这个作为自己的辩护点,自己递交10年申请。后来,更从SAR里面找到一页证明我的appeal right是在我回国后才到期的:

很好运, 我在这时候通过CAB的推荐, 找到我的律师。 首先, 我觉得他对我的CASE是明白怎么回事的, 而且他对我这个到底算不算连续性的问题,在法律上是灰色地带,也是了解的。 我之前见过的律师,对这方面是完全没有概念,或者觉得这不算断开, 当时这个律师不同, 他明白。 然后我跟他解释我自己找回来的资料, 他觉得我做的很好, 找到的资料都对我的CASE很有用,而且他也对我的看法作出评论和建议。 随后,我决定用他作为我的律师帮我递交10年申请。

其实COVER LETTER我自己已经写了一份, 我律师就帮我改了一下,加入一些更加专业的语句和段落。

总结:

  • 我对那些10年有问题的同学的建议就是: 你最了解你自己的CASE,所以你自己必须去找资料。 你就当你自己是你的辩护律师, 找到辩护方法后, 再当自己是法官去看你的CASE, 感觉你提出的为自己辩护的条据是否有理, 是否有破绽,如果有任何值得怀疑的地方,再去网上找相关的资料。

  • 如果败诉决定回国重新申请,应马上离开不应该拖更长的时间,不要以为有28天的逗留时间。因为这个时间并不算你有valid leave to remain. 但是,现在的移民法好像有些更改,好像在28天内能在英国国境内重新申请,我那会是不可以的(guidance上写的)。 所以我这篇是为那些马上或者1,2年内申请10年的同学参考的, 再 之后就要根据新法律而定了。

  • 其实并不是有拒签记录就一定不符合10年永居的要求, 要看具体情况, 比如说你离境的时候有没有valid leave to remain。 这点上我的case就是最好的例子。

我自己做了一个表格,写上我这10年来所有的签证,以及在每个签证内出入英国的日子,passport哪页的stamp,还有出入境的原因。

下面附上我的COVER LETTER作为参考:

We have been instructed by our above named client in her immigration matter. We are instructed to submit an application for Indefinite Leave to Remain following the completion of 10 years continuous lawful residence in the UK.

We enclose the following documents in support of the application:

 2x passport photographs with our client’s name, DOB and nationality on the back of each;
 1x record of absences from the UK;

Relevant Law

Long residence in the United Kingdom
276A. For the purposes of paragraphs 276B to 276D and 276ADE.
(a) “continuous residence” means residence in the United Kingdom for an unbroken period, and for these purposes a period shall not be considered to have been broken where an applicant is absent from the United Kingdom for a period of 6 months or less at any one time, provided that the applicant in question has existing limited leave to enter or remain upon their departure and return, but shall be considered to have been broken if the applicant:
(i) has been removed under Schedule 2 of the 1971 Act, section 10 of the 1999 Act, has been deported or has left the United Kingdom having been refused leave to enter or remain here; or
(ii) has left the United Kingdom and, on doing so, evidenced a clear intention not to return; or
(iii) left the United Kingdom in circumstances in which he could have had no reasonable expectation at the time of leaving that he would lawfully be able to return; or
(iv) has been convicted of an offence and was sentenced to a period of imprisonment or was directed to be detained in an institution other than a prison (including, in particular, a hospital or an institution for young offenders), provided that the sentence in question was not a suspended sentence; or
(v) has spent a total of more than 18 months absent from the United Kingdom during the period in question.
(b) “lawful residence” means residence which is continuous residence pursuant to:
(i) existing leave to enter or remain; or
(ii) temporary admission within section 11 of the 1971 Act where leave to enter or remain is subsequently granted; or
(iii) an exemption from immigration control, including where an exemption ceases to apply if it is immediately followed by a grant of leave to enter or remain.

Requirements for indefinite leave to remain on the ground of long residence in the United Kingdom
276B. The requirements to be met by an applicant for indefinite leave to remain on the ground of long residence in the United Kingdom are that:
(i) (a) he has had at least 10 years continuous lawful residence in the United Kingdom.
(ii) having regard to the public interest there are no reasons why it would be undesirable for him to be given indefinite leave to remain on the ground of long residence, taking into account his:
(a) age; and
(b) strength of connections in the United Kingdom; and
(c) personal history, including character, conduct, associations and employment record; and
(d) domestic circumstances; and
(e) compassionate circumstances; and
(f) any representations received on the person’s behalf; and
(iii) the applicant does not have one or more unspent convictions within the meaning of the Rehabilitation of Offenders Act 1974.
(iv) the applicant has sufficient knowledge of the English language and sufficient knowledge about life in the United Kingdom, unless he is under the age of 18 or aged 65 or over at the time he makes his application.

Submissions

Our client arrived in the UK on 25th April 2002 with a student entry clearance. She subsequently completed an English course, an AS/A Level course, her Bachelors Degree and Masters Degree. We refer you to the enclosed educational certificates confirming our client’s achievements in the UK. Our client is currently employed by the ____ as a _____.

Our client’s immigration history was straightforward until her last application for an extension of stay as a post study worker which she submitted on 25th August 2009 prior to the expiry of her last student visa. Our client’s application was refused on the grounds that she had not been awarded her Masters Degree at the time of her application. Our client filed an in-time appeal to the First Tier Tribunal but her appeal was dismissed. She subsequently successfully obtained permission to appeal to the Upper Tribunal but her appeal was ultimately dismissed by the Upper Tribunal in a Determination dated 6th September 2010. We refer you to the enclosed Determinations and in particular the recommendations made by the Immigration Judges regarding reconsideration of our client’s application.

However our client followed the advice of her then solicitor and UKBA to return to China and make a new post study work visa application from abroad instead of doing so in the UK. Our client left the UK on 15th September 2010 in order to submit this application. We refer you to the enclosed invoice in respect of her fresh visa application dated 16th September 2010. We also refer you to the extract from our client’s Subject Access Bureau file indicating that her application was received by the Visa Section in China on 17th September 2010. It is of note that our client’s appeal rights were only exhausted on 23rd September 2010.

We refer you to UKBA guidance on Long Residence Version 1.20 Page 24, Paragraph 4. In our submission our client had valid Section 3C/3D 1971 Act Leave from the time she made her initial PSW application for an extension of stay and at the time of her departure from the UK on 15th September 2011. Our client had Section 3C/3D leave until her departure from the UK. She was only absent from the UK for approximately 5 weeks before her return on 27th October 2010. Her visa was granted on 22nd October 2010. There was therefore approximately a one month’s absence from the UK in our client’s continuous lawful residence but as the time spent outside the UK is less than 6 months, continuous residence is deemed not to be broken.

We refer you to Long Residence and Private Life UKBA Guidance V3.0 Pages 12 – 16. In our submission it is clear that the continuous lawful residence period is not broken. We refer you in particular to page 14 of the Guidance and the exercise of discretion. Our client has acted lawfully throughout the 10 year period and has ‘made every effort to obey the Immigration Rules’. Indeed she left the UK in order to submit a new visa application in order to adhere to the requirements of the Immigration Rules in force at that time.

Our client is fully integrated into British society and has made a significant contribution to this country since her arrival in April 2002. Our client has not been convicted of any criminal offences and has never claimed any public funds. If our client’s application is granted she plans to obtain employment in a field related to her Degree. She has also indicated a desire to teach.

We submit that our client’s application squarely fulfils the relevant requirements of the Rules and policy applicable to her application. However if you require any further information or documentation prior to making a decision please contact us and we will attempt to furnish you with what you require.
We look forward to hearing from you with acknowledgement of this application.

顶一个!其实律师神马的,只是起到辅助作用,只有你自己能觉得差不多搞定的时候,他们的辅助作用才能体现。楼主的上诉过程完全体现了这点,一开始比较弱的时候,这帮王八蛋就轮番骗你钱,你自己专业了,律师就乐得做顺水人情。

现在大部分律师都是很水的,骗钱的。。。忘了跟大家说。有需要的可以PM我要律师资料。 我经历过的3个律师 (头两个垃圾,最后一个不错)都会告诉你们。

你那个其实都不算什么GAP啦,你PSW被拒,给你上诉权,而且是在被拒的28内上诉了,不算是GAP,是合法的。
然后上诉两次没有成功,一个礼拜后回国。这个只能算是8天的GAP。
然后回国申请PSW,这个也是合法的。10年间的签证不一定只是要求在英国境内,国内申请的签证也是可以的。只是好像要求不能断开有28天。
我只能说大部分唐人街的所谓律师都很业余。

不算GAP, 要算也算是BREAK, 就是10年断开了。

关键在于我上诉权是什么时候失去的, 是离开英国那一刻,还是如果我离开了英国,整个上诉权由开始的那一天算全部作废。 如果是前者,我的10年就连续了,如果是后者,就不连续。

所以我的COVER LETTER是尝试证明上诉权是在离开的那一刻才作废的,离开的时候还有VALID LEAVE TO REMAIN。 不过那只是我尽自己的能力去解释,明文上没有找到相关的条例, 我觉得是目前法律上的一个灰色地带。

也不知道是CASE WORKER 接受了我的解释,还是我好运。 反正现在是过了 {:5_137:}

2010年9月8日收到法院的信-2010年9月15日回国的这段时间应该算是GAP.
9.16号PSW在国内递交的那天开始就算是合法的了。
签证和连贯,那些唐人街律师说什么没有胜算啊,什么很复杂啊,都是蒙人的。我从来不相信他们。
