父母一方拿了PR后，是否孩子可以直接申请PR或者英国籍，我要稍稍更正下我以前所说的

大家都来英国很多年了，很多人都已经成为人父人母了。 :cn08: 孩子出生后应该办理什么英国签证呢？

这里我要详细讲解有PR或者英国籍的人的小孩身份问题，有理解不对的地方，一定要请达人们纠正以及补充 。以下所说的都是根据我的经验我对UKBA的条例理解整理出来的

孩子在英国出生

  1. 如果孩子是在父母一方拿到永久居留或者国籍后出生的话，那么孩子出生自动获得英国籍。 （1983年前出生在英国的孩子自动获得英国籍。） 无需申请登记入籍，直接办理英国护照即可。

If you were born in the United Kingdom on or after 1 January 1983, you are a British citizen if at the time of your birth one of your parents was:

  1. 如果孩子是在父母一方拿到永久居留前出生的话，那么孩子出生后的国籍应该跟随父母。不能够直接获得英国籍。 当父母一方拿到PR后，孩子可以用表格MN1来申请登记入籍，CASEWORKER会根据情况酌情考虑。 孩子的父母都拿到了PR的话，那孩子登记入籍的几率几乎100%

3.孩子在父母一方拿到了PR前出生，父母不想让孩子登记入籍。 孩子可以申请直接申请PR吗？ 答案是 MAY BE:cn14:

这种情况下，孩子必须先要申请临时的PERMISSION。 然后才能申请PR。

  1. 孩子在英国境出生，连续居留满10年可以申请登记入籍，无论父母的移民身份，即便是非法居留。

孩子在英国境外出生，这里我讲的就是在中国出生的宝宝

  1. 父母一方拿到了PR，那么孩子是否可以直接申请PR进入英国呢？

答案是 NO，除非以下特殊原因。 （父母都一方是PR，一方是英国籍，或者都是英国籍的情况下，孩子是有资格资格直接申请PR的。） 原文 Children cannot normally come to settle in the UK unless both parents are settled here or have been given permission to come and settle here. The only exceptions are where:

  • one parent is dead and the other is settled or coming to settle here; or
  • the parent who is settled or coming to settle in the UK has had sole responsibility for the child’s upbringing; or
  • one parent is settled or coming to settle in the UK and there there are serious reasons why the child must be allowed to come here.

    那么这种情况下孩子应该跟着父母一方申请结婚签证2年，2年后转PR。

  1. 父母一方是PR,一方是英国籍，或者都是英国籍，在英国境外出生的宝宝是可以登记入籍的，需要CASEWORKER酌情考虑 （谢谢sixday1004 提醒）

  2. 父母一方在孩子出生前就已经是英国籍，孩子的身份

根据中国国籍法，在中国出生的宝宝落地就是中国籍。 （第四条 父母双方或一方为中国公民，本人出生在中国，具有中国国籍。

第五条 父母双方或一方为中国公民，本人出生在外国，具有中国国籍；但父母一方为中国公民为并定居在外国，本人出生时即具有外国国籍的，不具有中国国籍。

第六条 父母无国籍或国籍不明，定居在中国，本人出生在中国，具有中国国籍。 ）

因为父母一方是英国籍，那么孩子可以跟随有英国籍的父母一方，自动获得英国籍！ （前提有英国籍的父母那一方不是靠血统来获得英国籍的）

选择了英国籍，孩子的中国籍就得被取消。

4.父母一方拿到了PR或者英国籍，那么孩子可以登记入籍吗

答案是不可以。 孩子在英国境外出生的话，父母一方后来拿到了PR或者申请入了籍，孩子是不具备资格登记入籍的。 除非父母都获得了PR， 或者一方拿PR，一方拿（或者正在申请）英国籍，孩子才有资格申请登记入籍。原文， Children in this category will be considered at the Home Secretary’s discretion and will
usually be registered only if both the parents are granted or already hold British
citizenship, or if one parent holds British citizenship and the other is settled in the UK.

想问一个问题，孩子的父亲是英国籍，母亲是学生签证，也就是说孩子出生之后直接就是英国籍，那么孩子的母亲在学生签证到期的情况下可不可以申请类似监护之类的特殊签证，为了留在英国照顾孩子呢？谢谢！！！！

孩子是由母亲照顾吗？ 如果父亲有监护权的话，妈妈最多每年签旅游探亲过来看看宝宝

孩子跟着妈妈就好办了。 论坛里面有人被拒签不过已经靠英国籍孩子上庭直接获得PR。

可以用FLR（ O ）表格来申请签证，这个表格你可以自己写原因并且提供材料为什么CASEWORKER应该给你居留。 英国是讲究人权的国家，所以在准备辅助材料方面尽量体现在孩子为什么不能跟着妈妈回中国，回国后会对孩子有什么不好处。

妈妈作为孩子的监护人，应该留在英国，还有父亲也有权利探视孩子，有义务抚养孩子到18周岁。

记住，申请签证一定要在签证没过期前申请，即便被拒的话，还有上诉权利。 法官通常是很心软的。

是英国籍。只要父亲不是在英国国外出生然后靠血缘(BY DESCENT)获得英国籍的（我说的不是靠归化入籍）

如果带有中国血统的孩子在英国出生跟着父母（父母至少一方为PR或者英国籍）自动获得英国籍的话，的确18周岁后可以放弃英国籍，前提是中国接受他。

但是如果孩子本身就不是英国籍，18岁之前也没有登记入英国籍，18周岁后也就没得选择国籍了
